Former Delta State governor, Mr. James Ibori has lost his bid to regain his world wide assets. A London court ruled that his assets remain frozen. The court therefore re-instated the restraint order on the former governor's worldwide assets worth $35 million. They also ruled that all of Ibori's worldwide assets are protected from dissipation. That means that neither Ibori nor his agents would be able to transfer or otherwise use the assets. Legal experts say the landmark ruling provides a critical and much-needed boost for the Metropolitan Police as they continue further criminal investigations into extensive money laundering activities carried out by Ibori and several accomplices. "Ibori is clearly in the pressure cooker," said a lawyer familiar with the case but who sought anonymity. "He is, legally speaking, in a huge mess. The ruling means that the justices are convinced that there's substantial—perhaps even overwhelming—evidence against Mr. James Ibori." A Federal High Court in Benin had denied jurisdiction to entertain a case brought by the Delta State Government seeking to deny the Economic and Financial Crime Commission, EFCC the powers to investigate contract awards and financial dealings during the eight years reign of Chief Ibori. The presiding judge of the court, Hon. Justice G. C. Okeke in her ruling agreed with the argument of the counsel to the EFCC, Mr. Wahab Shittu as well as counsel to the EFCC Chairman, Mallam Nuhu Ribadu and the Attorney-General of the Federation (AGF), Mr. Bamidele Aturu who all submitted that the High Court lacked jurisdictional competence on the matter brought before it by the Delta State government. While counsels to the state government, led by Mr. Ken Mozia argued that the court was backed by law and the nation’s Constitution to entertain the matter in the substantive suit; Shittu and Aturu argued to the contrary, pointing out that the originating summons was prompted by a letter from the EFCC requesting the Delta State government for information.

With today’s ruling, the EFCC is now free to arrest Ibori and try him for the offences which the agency listed in a counter-affidavit last week in response to the court order. Human Rights attorney, Bamidele Aturu told Saharareporters that the court decision vindicates his position that no court of law can prevent agencies of government from investigating and arresting crooks, "it is against public policy, I am glad the judge saw through this, it is a demonstration of the rule of law, EFCC did what is right".
